Bradley Nuttall Limited (BNL) offers clients access to the BNL website at http://www.bnl.co.nz

 

The BNL website contains information relating to the services we offer.

 

The following are the terms and conditions that will apply whenever you use our website or information that can be accessed from it.

 

All information that can be accessed from the BNL website is provided for general information purposes only. 

 

BNL reserves the right to vary these terms and conditions from time to time.  Any variations will be notified to you via the BNL website and will become effective from the time they can be accessed from the BNL website.

 

 

The Purpose of the Client Secure Area via the Website

 

 

If you register for BNL Online, Portfolio Information can be accessed via a portal link to another website operated by Aegis Limited. 

 

BNL, through its Aegis link, endeavours to make Portfolio Information available that is accurate and current.  Portfolio Information is principally based on information provided by the Aegis System operated by Aegis Limited and fund manager information provided to Aegis.  Accordingly BNL cannot guarantee the accuracy or reliability of Portfolio Information.

 

BNL does not make any warranties about the security of any information accessible on any website operated by Aegis Limited or the accuracy of any information that can be accessed from the BNL website or its suitability for any particular purpose.

 

You may not use any information that can be accessed from the BNL website;

 

·           to form the basis for decision making about investments or transactions concerning your portfolio; or

 

·           for communication by you to a third party for any purpose, including any application for credit.

 

We recommend that you contact BNL for specific investment advice before making any decision relating to your portfolio. 

 

 

Registration and Access to Portfolio Information

 

To have access to Portfolio Information via the BNL website you need to register with us, provide us with a user name, sign this form and return it to us.  

 

BNL will then issue you with an initial Set Up password.  This information will be known to both BNL and you.

   

It is then your responsibility to change the Set Up password and personalise this password when you first log on.  Once you have changed your password it will not be known to BNL. It is your responsibility to keep this new personalised password confidential.

 

BNL has taken all reasonable measures to provide for the security of its own website. It is your responsibility to contribute to security by following good practices when using your computer and the internet.  

 

If you cannot remember your password please contact BNL.  BNL will use best endeavours to confirm the identity of the person contacting BNL to enable a new password to be issued.

 

If you have any concerns about the security of any information that can be accessed from the BNL website, please contact BNL immediately.

 

You can also authorise other people (such as your spouse or a professional advisor) to have access to your Portfolio Information by nominating them on the attached form.  That person may then register with us. They will also provide us with a user name and will be issued with an initial Set Up password. From that point they will be bound by these terms and conditions. 

 

At any time you can withdraw that person's authority to access your Portfolio Information by informing us in writing.  We will then disable their user name.

 

 

Privacy

 

You acknowledge that personal information relating to you will be accessible by you via the BNL website and will be collected and held by BNL and Aegis Limited for the purposes referred to in this document.

 

Information about your IP address may be collected when you log on to the website. In addition, when you log on to the website your browser will be sent a memory based "cookie".  The data in the cookie is then used to validate you for every web page you request.  The purpose of this process is to limit access to your data.  When you close your web browser application the cookie in the memory is destroyed.

 

 

Intellectual Property

 

You may use information that can be accessed by you from the BNL website for the purposes described in this document and keep copies for your own use.  You may not make other copies or reproduce or publish information to other people.

 

You will not acquire any intellectual property rights to the BNL website or any other web page or site that can be accessed from it, or any information that can be accessed from the BNL website because of your use of the site.  So long as you comply with these terms and conditions you are granted a licence to use the BNL website and information that can be accessed by you from the BNL website in accordance with these terms and conditions.

 

 

Liability

 

Use of the BNL website or any other web page or site that can be accessed from it, or any information that can be accessed from the BNL website is entirely at your own risk.

 

BNL assumes no liability for any loss or damage or any sort, including for any negligent mistakes, errors or omission arising out of any persons use of the BNL website or any other web page or site that can be accessed from it, or any information that can be accessed from the BNL website including any claim arising from access to information by any other person or any claim arising from breach of your privacy.  BNL is not responsible for results of any action taken or not taken based on information that can be accessed from the BNL website.

 

You further agree to indemnify BNL for any loss suffered by it because of any breach by you of these terms and conditions.
